Marble Dating Corporation and its affiliates (“Marble,” the “Company,” “we,” or “us”) are committed to maintaining a safe and trustworthy private community and we understand that privacy and confidentiality are of the utmost importance to our members, applicants, attendees and other users (“you”). This Privacy Policy (the “Privacy Policy”) describes the types of information we may collect from you, or about you, or that you may provide when you use our applications (“App(s)”), any websites operated by Marble Dating Corporation that link to this Privacy Policy (“Sites”), and certain features thereof, or related services, including, but not limited to, those related to RSVPing and/or attending events which are advertised, featured, hosted or otherwise disseminated through the App (collectively, the “Services”).
We encourage you to read this Privacy Policy and our Terms of Use carefully and to contact us at contact@marbledatingapp.com with any questions you may have. By using this App and interacting with our Services, you are agreeing to the terms of this Privacy Policy, as posted here. If you do not agree with any terms or practices described herein, please do not access or use the App, Sites, or any of our Services.
INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT
Information You Provide in Connection with Membership.
When you download the App and create an account (“Account”), we may collect certain information (“Registration Information”) about you, such as:

Characteristics of protected classifications under federal law - such as race, religion, ethnicity, gender, age - and under California law - such additional categories as sexual orientation;

Information regarding your personal interests;

Contents of App messages unless we are the intended recipient of the communication;

Inferences drawn from the above categories.
When we review your Account for membership approval, you authorize us to access information from your Instagram account, such as your username, profile picture, biography, website, list of followers, list of people you follow, and number of pictures, as well as your phone contacts. This information is used to verify your identity and to evaluate your real-world connection to our existing members, among other things.
You will also be asked to allow us to collect your geographical location information and you may respond to such request by allowing us to collect location information at all times, only while you are using the App or not at all. In addition, we may collect and store any personal information you provide in connection with your application, while using our Services.
In connection with your use of our Services, you may also provide us with images, responses to prompts, descriptions of dates you create, information about reservations you upload, information about your gender and preferences for recommendations and connections. Some of the information that you provide may be considered “special” or sensitive” in certain jurisdictions. By choosing to provide this information, you consent to our processing of it. Any information you provide may be viewable by other users of the Service. If you communicate with other users within our Services, you hereby agree to provide us the content of your conversation. Should you contact us with an inquiry, we may collect the content of that correspondence or interaction. You may change your personal information (other than your date of birth) at any time within the App settings.
Information Other Users Provide. In addition to the information that you choose to provide to us, other users may provide information about you as they use the Services if, for instance, they interact with you, they contact us about you, or you are a contact in their phone.
Information Collected Automatically. In addition to the information you provide, certain information will be automatically collected as you use our Services, including, but not limited to, the operation system used by your device, your device type and ID, your IP address, how and how often you interact with other users and your access times. If you grant us permission to use location services, we will automatically collect data regarding your geographical location at all times or while the App is actively running, depending on the permission that you grant us. Note that even if you do not grant us permission to use location services, we may collect data regarding your city, state and general location (not your exact location) through your IP address.
Third Party Websites. In the event you access a third-party website through your in-app browser, such third-party websites may independently solicit and collect information from you. You should consult the privacy statements available on such websites as their policies are beyond our control.
Financial Information. As we exclusively accept payment through third party services such as Apple, we will never ask for your credit card information and your financial details are, and will remain, secured by and subject to the applicable third party’s security and privacy policies.
USE AND SHARING OF YOUR INFORMATION
We may use or disclose the personal information we collect for one or more of the following purposes:

To detect security incidents, protect against fraudulent or other criminal activity, debug and repair errors, and help maintain the safety, security, and integrity of our App, Site, products and services, databases and other technology assets, and business.

To personalize your App experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our App, third-party sites, and via email or text message (with your consent, where required by law).

To perform testing, research, analysis and analytics internally or by using a third-party service, such as Google Analytics. Any information that we disclose to Google Analytics is subject to Google’s privacy terms.

To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

Information Shared with Other Users. When you register as a user of our Service and create an Account, your App profile will be viewable by other users of the Service. Such other users will be able to view information you have provided to us directly in creating your App profile or through Instagram, such as:

Your Instagram username;

Photos you upload;
-
Your name;
-
Dating region;
-
Education;
-
Professional or employment information;
-
Height;
-
Political beliefs;
-
Information regarding your personal interests;

Characteristics of protected classifications under federal law - such as race, religion, ethnicity, gender, age - and under California law - such additional categories as sexual orientation;

Dating intentions;

Hometown;

Your answers to prompts; and
-
Information you have in common with the person viewing your profile, such as mutually followed Instagram accounts.
A request by you to join another user’s date and an acceptance of such request by that user, or a request by another user to join your date and your acceptance of such request, enables you to chat with that person through the Service. Similarly, an invitation from you to another user to join your date and an acceptance of such invitation by that user, or an invitation from another user to you to join their date and an acceptance of such invitation by you, enables you to chat with that user through the Service. Should you engage in a conversation through our Service via text chat, that user with whom you are communicating will see the content of that interaction. By submitting an application to Marble, you are giving the App access to your Instagram profile through the use of Instagram’s API. However, the Instagram information automatically available to users of the App will not exceed the information otherwise accessible through your Instagram profile. Therefore, a “private” Instagram user profile will still be private; only the content you choose to share with App users will be visible.
Waitlisted Applicants. Only other users whose applications have been accepted will be able to see your App profile. Applicants who have been waitlisted will have no way to know or see that you are a member of the Marble community just as users cannot see which applicants have been waitlisted.
Information Shared with Third Parties. We may disclose personal information that we collect from you or that you provide as described in this Privacy Policy:

To promotional partners that provide promotional benefits to you as a Marble member.

To contractors, service providers, attorneys, banks, auditors, and other third parties we use to support our business working on our behalf for the purposes described in this Privacy Policy.

To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Marble’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Marble about our users is among the assets transferred.

Aggregated and Non-Personal information. In addition to the uses of your personal information referenced above, we may use and share non-personal, non-identifiable information we collect through your use of the Service. We may also use and share aggregated, non-personal information with third parties including contractors, advisors, investors and professionals for purposes related to our business.
Cookies and Other Similar Data Collection Technologies. A cookie is a small file placed on the hard drive of your computer by websites that you visit. Cookies are widely used to make websites work, or work more efficiently, and to provide information on web browsers, such as browser type, time spent on a website, pages visited, and other traffic data. We may use cookies and similar technologies to recognize you and/or your device. This may be done to, among other reasons, authenticate you, remember your preferences and settings, analyze usage trends and allow you access to certain features of the App.
Choices About How We Use and Disclose Your Information. You may wish to restrict the use of cookies. Please be aware that some features of our Services may not function correctly if you disable cookies. Most modern browsers allow you to change your cookie settings. You can usually find these settings in the options or preferences menu of your browser.
PRIVACY RIGHTS AND ADDITIONAL DISCLOSURES FOR CALIFORNIA RESIDENTS
Tools to Control Your Information. We want you to be in control of your information, so we have provided you with the following tools: (i) account settings that help you to access, rectify or delete information that you provided to us and that is associated with your account directly within the Service; (ii) mobile device permission systems for specific types of device data and notifications, such as phone book and location services as well as push notifications, which you can use to change your settings on your device to either consent or oppose the collection of the corresponding information or the display of the corresponding notifications; and (iii) you can delete your account at any time by navigating to Settings, scrolling to the bottom of the screen, and pressing “Delete account”. You can also, at any time in your sole discretion, withdraw any consent that you give us with respect to your personal information. You have the right to obtain your personal information that you provided to us and you may use such information elsewhere.
Verification Process for Exercising Rights. To protect our users’ privacy, we verify privacy rights requests to ensure that only you (or your authorized agent) can exercise rights pertaining to your personal information. As part of our verification process, we may request you to submit additional information.
If you are an authorized agent wishing to exercise rights on behalf of a state resident, please contact us using the email address above and provide us with a copy of the consumer’s written authorization designating you as their agent. We may need to verify your identity and place of residence before completing your rights request.
We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
Appeal Process. If we do not decide to act in response to your request to exercise a right, we will provide a timely response detailing the reasons for not taking action and, depending on the circumstances, any rights that you may have to appeal our decision.
Response Timing and Format. We will confirm receipt of your request within ten (10) business days. Then, we will endeavor to respond to the request within forty-five (45) days of its receipt. If we require more time (up to 90 days), such as to verify your identity, we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response electronically.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
California Residents. If you are a California resident, California law may provide you with the following additional rights regarding our use of your “personal information,” as defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020, and any regulations promulgated thereunder.

California “Do Not Track” Disclosures. California law requires us to let you know how we respond to web browser Do Not Track (“DNT”) signals. This feature lets you tell websites that you visit that you do not want to have your online activity tracked. Not all devices and browsers offer a DNT option and DNT signals are not yet uniform, so, for this reason, Marble, like many companies, does not currently respond to DNT signals.

California “Shine the Light” Disclosures. California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Sites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We will respond to your request in accordance with applicable law and reserve our right not to respond to requests submitted other than to the email address specified in this section.

Access to Specific Information and Data Portability Rights. Residents of California have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. To request this notice, please submit your request to contact@marbledatingapp.com. For your protection and the protection of all of our users, we may ask you to provide proof of identity before we can answer such a request. Once we verify your request, we will disclose to you:

Limiting the Use of Sensitive Personal Information. Residents of California have the right to direct us to use or disclose sensitive personal information only for providing goods or services, or as otherwise minimally permitted under applicable law. KEEPING YOUR INFORMATION SECURE
Security Measures. We take the security of your information very seriously and have implemented a number of measures to safeguard it. Please be advised that, although we take reasonable technological precautions to protect your data, no website, application, or data transmission can be guaranteed to be 100% secure. Therefore, we cannot and do not guarantee that your information will be secure. Any transmission of data at or through our website, Services or Apps is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the App or Sites. If you believe that your account or information is no longer secure, or otherwise have information that may be relevant to us regarding information security, please notify us immediately at contact@marbledatingapp.com.
Retention. We retain personal information only for as long as the information is needed to fulfill the purposes for which it was collected and processed. We will delete, anonymize or de-identify personal information within a reasonable time after the data is no longer necessary for the business purposes for which it was collected. We will, however, retain and use personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
TEXT MESSAGES AND OTHER COMMUNICATIONS
By using the Service in any capacity, including RSVPing to an event or otherwise engaging with our events feature, you agree to receive text messages and other correspondence from us regarding event updates as well as upcoming events, features, and other promotional matters, which messages and other correspondence may be based on information that you have provided and other data that we have collected based on your use of the Service.
AGE POLICY
Must be of Age. We restrict our Service to people who are 18 years of age and older. Only applicants 18 and over will be considered for acceptance, but we are not liable should an applicant misrepresent their age in their application. Should we become aware of a user who is not at least 18 years of age, we will immediately remove that user from our Service. We do not knowingly collect, maintain or use information from children under the age of 18.
NO RIGHTS OF THIRD PARTIES
This Privacy Policy does not create rights enforceable by third parties or require disclosure of any information relating to users of the Service.
CHANGES TO OUR PRIVACY POLICY
We will occasionally update this Privacy Policy to reflect changes in the law, our data collection and use practices, the features of our Services, or advances in technology. When we make changes, we will revise the “updated” date at the top of this Privacy Policy, which will be posted at https://marbledatingapp.com/privacy. We encourage you to regularly check for the most recent version, as your continued use of our Services following the posting of changes to this Privacy Policy will mean your consent to and acceptance thereof.
